O presente artigo procura explorar o conceito de direito fundamental ao recurso no processo penal brasileiro. O principal objetivo é apresentar uma nova configuração do instituto e compará-lo com os tratados internacionais de direitos humanos.

ABSTRACT

The present article intends to explore the concept of the fundamental right to appeal in Brazilian criminal procedure. The main objective is to present some new configuration of the institute and to compare it with the international treatise on human rights.
